Wills & Estates

TMB law is here to help all our clients maintain the utmost control in the event of an unforeseen circumstance. Planning and drafting written instructions in advance ensures that you retain control of any decisions relating to your assets and your children.  Our experienced team can draft your will or even update an existing will. Wills do need to be updated in different stages of your life, such as your children getting older, cohabitating with your partner or going through a separation.

Our office will assist you in preparing the correct documents to appoint an executor of your estate and the documents they will need to carry out your wishes as stipulated in your will.

Deciding on a Power of Attorney also helps you prepare in advance of any unforeseen circumstances and to avoid the lengthy process of potentially having the Ontario Public Guardian and Trustee appointed if you have not made a selection.

There are two types of Power of Attorneys.

  • Powers of Attorney for Property: By Appointing an attorney, they are responsible for managing your property, business and financial affairs in the event that you have become physically or mentally incapable of doing so. You can choose more than one individual to act “jointly” as your attorney and have a substitute attorney in the event that the first in unwilling to act.
  • Powers of Attorney for Personal Care: The indivudal chosen to be your attorney is responsible for decisions regarding your care and medical treatment when you are not able to do so. You can provide specific instructions in your power of attorney, that they will have to follow, in any circumstances.

You will require a witness to sign these important documents and there are certain legal requirements that must be followed for the execution of a Power of Attorney. TMB Law’s experienced staff will be able to guide you through this process and ensure that you continue to have maximum possible control of any decisions in any circumstance.
